The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

    I have overstayed my residence permit for about 19months. Is it possible to get an entry-ban for less than 6months?. Can the entry ban be lifted at the Turkish consulates abroad?.

      The height of the penalty depends on the officer on the border. If you receive a ban, you must contact the embassy or consulate to abolish it.

  2. Hi,
    I am an Afghan citizen but live in USA with permanent residency. Me my wife have permanent residency in USA and my daughter is a US citizen. We want to visit Turkey to meet our relatives. When applying to e-visa it told me that the stay is for 30 days. What is the fine if it extends more than 30 days. Is it possible to extend it more than 30 days as I know I may be staying around 45 to 50 days. And I guess my daughter being a US citizen does not fall into 30 day stay rule. Is that right?

      Your daughter and wife, as US citizens, can stay in Turkey for 90 days, but you can stay in Turkey for only 30 days. If you exceed 30 days, you will have to pay a penalty at the airport leaving Turkey.

  4. Hello,
    I’m Lebanese and I’m heading to turkey in a couple of days. It was an out of the blue decision, hence I’m heading there without a permit and honestly without a clear plan to what I want to do. I do want to start a new life there. Now I am aware I can only stay there for 90 days. I was thinking about applying for different universities while I’m there and then trying my luck basically with a student permit till I decide what to do afterwards. I’m still young and I’ve finished one year of college here but due to certain circumstances I have to leave and turkey is my only option at the moment. Is it a possibility for me to apply for long term residency? And do I have any solution at all for prolonging my stay in turkey?

      You can not get long-term residence permit in Turkey for 8 years without interruption, in the short-term residence permit must be purchased or rented a house in Turkey, you are also required to have $ 6,000 in your bank account money for a year. You will need to register for an enrollment for the student residence, you can receive the student residence with your admission letter, remember that no residence permit is a substitute for a study permit.

  5. hello ..i m from india.last year i went turkey and overstayed for 4 months while i applied for turkish residency and i attended the appointment and the officer demands me for the few documents and that period in emergency work at homecountry i came back without attending appointemt again.i paid 360 turkish lira as fine.now i wnna go back turkey so ….can i go back again without any problem …with a valid visa

  6. Hello.
    I have a three months visa but the duration of stay was 30 days. I have stayed here 2 months without knowing about the duration of stay. I passed my two months completing the documents required for residence permit. My appointment was today 2 jan 2018 but my duration of stay was over on 8 nov 2017. However, my visa expires on 12 jan 2018. I was not aware of that. And now they tell me that the duration of stay is complete before the appointment and they cannot do anything. What should i do?

      The only way now is to leave the country, pay the administrative fine for overstayed period of time at the Customs on your departure day and keep this recepit. If you still planning to return back to Turkey, kindly ask you to ask Customs if you are able to return back immediately to Turkey, if yes, then you should get a new visa from your homecountry and come back.

    I am from South Korea, and I am now staying at Ankara for taking a Turkish course offered by TOMER for two months. (Recently, I entered Turkey on 25 Dec 2017 without visa)
    The problem is that when I come back to South Korea(leave Turkey) on Februrary , I guess that I have trouble in overstaying at Turkey because of the breach the 90 in 180 days rule during my stay in Turkey, Last time, I visited Turkey without Visa and stayed at Turkey for 37 days(I left Turkey on 1st September 2017). Because I plan to leave the country as soon as my Turkish courses finish, I think it better to pay a penalty for overstay than to applying for a residence permit. In case of overstay of more than 10 days, how much is expected to pay for a penalty at the airport? I saw the charts of the administrative penalty provided above, but I do not understand how I calculate a penalty exactly. If I plan to overstay 20 days, how much do I pay?

      You should apply for a residence permit. However, if you do not do it you will have to face a penalty of around $ 100. Please note that the final decision on the amount of the penalty is made by the officer at the airport. The penalty must be paid in cash. If you do not pay a penalty, you may be banned from entering Turkey.

  8. I am visiting Turkey in March 2018 with a 180 day tourist visa/ multiple entry. I intend to apply for a residency visa while in Turkey. My question is: Once I have applied for the residency visa must I remain in Turkey until my hearing date or will I be allowed to leave Turkey and return prior to the hearing?

      After reserving your meeting during your visa period you can leave the country and come back without consequences. After the expiration of your visa and after booking a meeting with an immigration office, you can leave the country for a period of 15 days after receiving a special permission from an officer.

I have overstayed my visa by 4 months, I am a British national and I have booked the flight for 31st, do I simply do to the airport with enough money to pay the fine, should I go to my embassy to complain because I have been really ill and I intend coming back to turjey6to continue some research I have been doing
