The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. In addition to the permit fees, if applicable, administrative fine may include residence permit card fee  and single entry visa fee.  (For details permit fees page.)

RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

    I am doctor an Afghan national. My name id Dr Mir Dost Mohammad I came here fortwo montjs training in sanli urfa harran university hospital.
    Mynstay in visa is forthirty days.
    If I spent one two months than what consequences I will face or how much fine will Ipay while leaving turkey after spending extra thirty days.

    If I spend extra thirty days than my stay how much fine I will have to pay when I am leaving turkey.

      The penalty for exceeding the stay is payable in the cash desk at the airport.
      The final decision on the amount of the penalty is made by the officer at the airport.

  2. I have a friend who is currently in Turkey and has overstayed his visa and doesn’t have the money for the overstay fine. If he books his ticket will they allow him to leave.

    I’m a British National in Istanbul, Turkey. I applied for a tourist shot term residence permit at the beginning of November 17. Due to the high volume of applicants my appointment is on 8 Feb 18.
    I left the country for a job interview to Dubai on 7 Dec where I had to pay a fine for overstaying even though I told them that I’ve got an appointment for my residence permit. On my way back I was stopped from entering the country I asked to sign a piece of paper agree to apply for a residence permit within 10 day which I have already done beforehand.

    Now I’m expecting a phone call at anytime to go back to Dubai to start my job. Will I be able to leave the country without being stopped and getting a fine nor a ban? And if I leave will I be able to come back for my residence permit appointment on 8 Feb 18?

    Please advise me on what to do as I have been advised by an employee in Istanbul Department of Immigration to not leave the country until I attend my residence permit appointment. Otherwise if I left the country before that I would get a ban of 6 months to 5 years depending on my nationality.

  4. thankyou for your answer re overstay fees please can you tell me how do you know waht fees will be charged at airport is their a scale of fees for overstay that you can lookat before you get to airport so that you can with draw the required amount of cash when you get to immigration there .pther wise if you wait till you get to immigration and they telll you overstay is US 1000 where are you going to get this are their auto tellers at immigration for you to get money out of .

    Does she get a plane ticket and pay the overstay fine at the airport in Istanbul and how much is the fine would it be over $2000US
    Does she have to go to the foreigners police dept first of all or just pay fine at air port

  6. Hello, Dear Sir/Madam

    I have question, I’m Indonesian, I’m planning to visit turkey to see my family who’s studying there. I already had e-visa for 30 days stay. but I just realized that my return flight will be on 30th day (domestic flight from ankara to istanbul) and then my international flight (istanbul to saudi arabia) will be on next day (which is 31st day). Will that be a problem? should I reschedule my flight to earlier time so my international flight still within 30th day (to avoid any fine)?
    fyi: i’ll arrive in turkey Dec 16th 2017, and return flight will be on January 13-14th 2017 (domestic-international flight).

      I suggest changing the date of departure from Turkey so that it will fit into the planned 30 days according to the visa. If you stay one day longer in Turkey than provided for your visa may be that the only employee at the airport notify the expiration of the visa but it can also impose a financial penalty.

    Benim Eşim 07 Ekim ayında Türkiyeye turistik olarak geldi. sonra ben Türkçe Dil okuması için ” Tömer yazdım” ve onu ikamet izni almak için Göç idaresine başvurdum. fakat kaçırdığımız bir nokta vardı. ilk otuz günü başvur yapmamsı gerekiyordu. fakat bazen sepeblerden dolayı ve Tömerden Alacağımız belge geç elimizde geçmesi ilk 30 günü on gün geçti .bu durumdan sonra Göç idaresi başvur kabul etmesi için bir ülkeden çıkış ve Giriş yapınız ve tekrar başvur yapınız dedi.

    böyle bir durumdan sonra bazen maddı sıkıntılardan dolayı eşım çıkmadı. şimdi 18-12-2017 Somaliyeye göndermek istiyorum. tekrar vize almak için . benim sizden yardımcı olmanız ıstedığım iki tane soru var ;

    Acab somaliya vize ihlali nekar para ödenir. günlük olarak. eğer ulaşbilecğım bir link varsa söyler mısınız.

  8. Oh sorry one more question to my previous mail… What if I leave Turkey on the 17th December by using my tourist visa and not the temporary residence permit? Last time i came back to Turkey on the 2nd September by using the visa so 90 days i already used of it so i may could use the visa again (180/90 days starts again?).

    I am hungarian and a few days ago i renewed my family residence permit in Ankara. I got the temporary res. permit paper… The officer (at the immigration office) said to me it would be not a probleme if i travel to Hungary on the 17th December and stay until 11th January but then (a few days later and after I bought my flightticket) i noticed the 15 days validation on the paper. So i would overstay and I don’t know exactly what would happen to me when i will come back to Turkey. I called the immigration office, they said there will be a penalty but they donnow how much.. Unfortunately i heard about wilder situations too (cancellation of the residense permit or ban to enter to Turkey) so I don’t want take any risk and it seems i have to change my flight…
    Am I right? What are the experiences at this case? I heard about a 10 days tolerance time too…
    By the way i don’t understand why the officer told me that it would be not a probleme… He was who asked me how long i would be away…

      If you have the option to change the date of travel, do it and avoid punishment. According to what the officer said to you, you will receive a financial penalty set by the officer. Penalty paid at the airport in cash.

      1. For your information: I didn’t receive a penalty at the border. The officer could see my new res. permit in the computer and he said everything is ok.
