Work Permit Applications

Applications for work permit are made through e-Government portal of Turkey (www.turkiye.gov.tr). The automated work permit application system enables the users to fill the online work permit application form and upload necessary documents into the system. Once online application is made through the e-government portal, the employer is required to make direct application to the Ministry by mail or in person.  Duly applications are finalized by the Ministry at most thirty days and once the decision is made, the ministry informs the applicant through e-mail. Foreigners residing outside the Turkey can make their work permit applications through the Turkish representative offices in their home countries. In the existence of residence permit valid for at least 6 months, foreigners residing in Turkey can make their applications directly to Ministry of Labor and Social Security.

1.   FOREIGNERS RESIDING OUTSIDE OF TURKEY

Foreigners residing outside the Turkey are subject to apply for work permit from the representative offices of Turkey in their own countries. Pursuance to work permit application of foreigner, within 10 working days the employer should process both online and direct applications to the Ministry of Labor and Social Security in Turkey. Once the approval from the Ministry is granted, foreigners are required to apply for work visa to the Turkish representative office within 90 days.
As per new rules on residence permits, valid working permissions will be now used as residence permits as well. Thus work permit validity requirement of residence permit application within 30 days upon obtaining the work permit (for consulate applications 30 days was starting upon arrival of work permit holders) will be outlawed.  On the other hand the same as work permits, “Work Permit Exemption Certificates” will also be used as residence permits.

2.   FOREIGNERS RESIDING INSIDE TURKEY

Foreigners with residence permit valid for at least 6 months may make their applications to the Ministry of Labor and Social Security internally. Internal applications are made by the employer directly to the Ministry. Once the online application is submitted, the employer is required to make direct application to the Ministry within 6 working days.

3.   WORK PERMIT EXTENSION APPLICATIONS

Extension application of the work permit period is made to the Ministry of Labor and Social Security. As Internal applications, after submitting online applications, direct application to ministry should be made within 6 working days. The application for extension should be filed within 2 months before or 15 days after the expiry date of the work permit.  After 15 days period, the applicant no longer may request for extension and the application is regarded as initial application.

If you decide to work in another field you can search for a job through websites such as http://www.kariyer.net and after you find one your future employer must apply for your work permit. Foreigners can not apply for work permit in their own name or without having a job in Turkey. Application for foreigner who has residence permit valid in total for at least 6 months can be done within Turkey. For foreigners who are not residence permit holders, application must be done via Turkish Consulate in their home country.

    Could you please make more clear the 6-months rule when applying for a work permit in Turkey. Does it mean that the applicant should have residence permit that is valid at least 6 months at the moment of application for the work permit? Is it possible to apply for a work permit if I hold 6 months residence permit that is about to expire at the time of application for the work permit?

      In order to submit work permit application residence permit must be valid in total for at least six months. Application can be submitted until the expiration date of residence permit, left duration is not taken under consideration. As your residence permit has been granted for 6 months in total, your employer can apply for work permit on its basis before your residence permit expires.

    Hello, i am an english teacher, i have recently extended my residence permit for work purpose, in order to be able to apply for work permit. Today my employer informed me that it won’t be possible to apply for work permit for me as due to the coronavirus effect on the school there are only 3 teachers without my account, and to apply the minimum number should be 6. I don’t know what is my situation anymore. Is it okay to wait for 2 months and then apply for the work permit and is my situation legal or what should I do. Knowing that I have a valid residence permit.

      Hello,
      As work permit has not been issued, it does not affect validity of your residence permit. You are allowed to stay in Turkey legally until expiration of your residence permit however you are not allowed to work until you receive work permit. Your employer can submit work application once school employs 5 Turkish citizens or if you find another employer, application can be made until the last day of your residence permit’s validity.

    Hello, i have a work permit that expires until 2021 but due to COVID19 my company fired us without any financial support. Is it possible to make a tranfer of work permit to another company that accepted me? Can my current company that closed in March refuse this transfer or it is my right to do it?

      If your work permit has not been cancelled by the company by now, work permit transfer can be made with participation of both companies. However, if the company has already cancelled your work permit, your new employer can only make the application through Turkish consulate in your home country. Company has a right to refuse the transfer but it is not a common practise in Turkey.

      Foreigners can establish a business in Turkey with minimum capital of 10.000 TL, however in order to obtain work permit for company owner/shareholder, company’s paid capital must be 100.000 TL or more. After staying in Turkey for five years uninterruptedly on basis of work permit you can be eligible for Turkish citizenship application.

          It is correct, there is an obligation to hire 5 Turkish citizens per each foreigner applying for work permit, including company owner/shareholder. During evaluation of work permit application amount of Turkish personnel during last 6 months before submission of the application is taken under consideration.

        If the branch of company in Turkey meets criteria of Ministry of Labour as paid capital of 100.000 TL and employing at least 5 Turkish Citizens per each foreigner, work permit application should be done by the owner of the branch. After the application would be approved, foreigner will receive work visa in order to enter Turkey and start working.

    Further to the above, what type of contracts should the 5 Turkish citizens should hold? Can they be on an “On-Call Contract” or “Part-Time Contract” in respect of the labor Law?

      Thank you for the reply, if a foreigner want to open a coffee shop or resto Cafe business kiosk is he eligible for a work permit with 5 turkish employees?

      What if the resto Cafe can only accommodate 2 at a time but branch out to other branch and combines to 5 turkish employees will that guarantee a work permit? Or each branch should have a separate license? With 5 employees in total or both will be considered under one permit as they are under the same owner?

    My company applied for my work permit 3 months ago and we still didn’t receive any answer. (They applied one month before my residence permit was done. Is this a problem?)
    Now I want to know if I want to cancel and go back to my country. Do I have to pay any fees? will I have a problem with police at airport?
    They applied for my colleague after me and he got his work permit.

      Work permit applications are being evaluated in approximately 30 working days. Your employer should contact the Ministry of Labor to check the status of your application. If your residence permit has expired in the meantime, you will need to pay a fine while leaving Turkey.

    Hello, I want to apply for a work permit bit I want to know how money is deducted from my salary. I have a residence permit. I tried to talk to my boss and he was worried about paying insurance for me. I told him I have my insurance.
    I want to know if the insurance I used for residence is the same I can use for work permit.
    Secondly, I want to know how money will be deducted from my salary every month. Let’s assume am being paid 2000tl.
    Lastly, I want to know if everytime I want to renew my work permit I will need a residence permit as a supporting document. Thanks

      There will be no amount deducted from your salary. If you agree for a net salary with your employer, all of the other expenses should be covered by the company. However, be informed that the minimum gross wage for foreigners for 2019 is 3.837,60 TL, which is approximately 2750 TL of net salary. Insurance used for residence permit can not be used for work permit, employer must register you in Social Security. You will not need residence permit to extend work permit.

        Hope you are doing good . My question is , is it possible for an expat( non turkish national) to get a hostel/hotel building on rental basis in istanbul for 1 or 2 years . For business purpose
        Is there is any restriction by the government in case of this type buisiness.

        It is necessary to hire minimum 5 turkish national before registering a company for hostel business.

          Foreigners are allowed to do this kind of business in Turkey after registering a company here. Hiring 5 Turkish is not obligatory for registering the company, however it is required in order to obtain work permit for a foreign company owner.

    I am engineer tamer from Egypt.
    I received a signed contract and offer from a Turkish company in Istanbul and the instructed me to contact expat cont office for a work permit and resident visa procedures and that i need to pay the fees to this office to apply and receive the required permits and visa ( family contract ).
    Once i contact the mentioned office through email and their website, they reply to me with some documents i need to fill and fees of approx. 2500$ ( family ).
    I need assistance to make sure that is not a scam or fake issue to do the requested.
