The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

  1. I have a question regarding the 90/180 rule. I have been traveling back and forth Turkey since October 2015 and I understood (probably wrongly) that I should start calculate the 180 days from the very first time I entered the country. By doing so, I never had any problem and I never overstayed in the country. Now I am facing the problem and using a calculator online I realised that my overstaying is starting tomorrow. Is the 180 days calculation renewing itself every year?
    I came first time in Turkey in October 2015 and I always calculated 180 days by having the renewing time in October and April. I was wrong. So now, I can leave the country in the next days, pay the fee for the days I overstayed but my 180 days allowance will end on the 28th of June. That means I cannot come back here until that date? Or for the fact that I leave the country and I pay the fee I can come back the day after?

    I am a self employed and I am trying to find a way to live here. Any way I can get a residence permit? I would attend also a Turkish course if possible and helps.

      In order to start new 180 days period of time, foreigner should leave the country and enter on basis of new issued e-visa. If your visa is already expired, you should leave the country and pay the administrative fine at the airport on your departure day. By getting new evisa you may come back to Turkey and apply for residence permit, which allows you to leave the country and come back at any time.

  2. Hello, my student resident permit expires on 2nd of June but because of exams at University I have to overstay and return about 8 days later. When I return and I firstly have Turkish domestic flight then international flight, where I need to pay the fine?

  3. I want to know how much is the fine for overstaying in Turkey?
    I overstayed here around 10 months! I am in short of money now, so I should know how much I should pay in border. because I dont want to be deported and get 5 years ban. So need to know almost exact fine amount . is it more than 1000 TL? (nationality . Iranian)

    And i paid 480 tl fine for overstaying
    Last month i went to sabiha gokçen airport and they said to me: you are banned from entring turkey

    What is that how can i enter to turkey

      Did the officer at Customs informed the banned period of time? The only way to come to Turkey is to wait while the ban will be removed or get new visa from the Turkish Consulate in your hoemcountry.

  5. I overstayed 37 days while being in Turkey. I always stayed less than 90 days on one single entry, but in the last 6 months I passed the 90 day limit (although this is not stated like that on the eVisa-website, and I was not aware of this rule). On exiting the country last week I had to pay 145 TL due to this overstay. I would like to fly back in a few days and then apply for a residence permit.
    Do you know if they would let me back in? I can show that I have paid the fine and I also got a new eVisa. The Turkish consulate told me I should re-apply for a visum through them, which will take one month (!). I really need to fly back as soon as possible.
    What’s the best I can do? Should I fly back and hope for re-entry?

      If you paid your penalty at your exit of territory and you were able to get a new e-Visa you should be able to enter the Turkish territory without any problem if you don’t have any entry ban.
      To check if you have an entry ban you should check with your local Turkish Consulate. In this case you will have to apply for a Visa from the consulate.

      Our advice would be to first check with your local Turkish Consulate and then if don’t have a ban apply for an e-Visa.

  6. Hi

    My tourist visa ended on April 11th, 2017. Now i am taking care my resident permit and just got a randevu on May 9th and now i am on process to finish all for the resident permit because the officer give me time 1 month after the randevu date. My question is on June 22nd i got to go back to my country (i need to join the graduation ceremony in my university), but i wonder when i pass the passport control gate will i pay for the overstay penalty or i just show to the officer that i already take care my resident permit (even it might be not yet done and still randevu)?
    And also if i already pay for the resident permit before i fly back to my country, when i come back again to turkey should i apply again a resident permit? What kind of visa i made for me to come back again to turkey? Will i get banned to re-entering turkey?

    I hope there will be answers for my questions.

      Our suggestions will be to complete missign documents before the deadline and get a temporary residence permit paper which allows you to leave the country for 15 days. İn case if you leave the country before submitting missing documents to the immigration office, in this case you should pay the administrative fine and leave the country, get a new touristic visa to Turkey and re apply for residence permit again.
      The decision of banning your entrence will be taken by Customs on your departure day. You can ask the Customs officer on your leaving day

        What does it mean by get a paper for a temporary residence permit which allows me to leave the country for 15 days?
        Does it mean i only got 15 days to stay in my country before i back again to turkey?
        Or does it mean i got a 15 days in turkey before i have to go back to my country?
        Anyway for the ban subject, to get to know i banned or not does it only depends on the custom officer in turkish airport? Or i will get informed if i am banned from visa system when i apply visa again from my country?

          The 15 days document mean that you can stay 15 days outside of Turkey. If you pass this period of time your residence permit might get cancelled.

          If you get a ban you should be warned by the officer at the Airport. You can aslo check if you have an entry ban at your local Turkish consulate.

            Actually my residence permit is on process now, i only have to add sigorta and go to noter to make a statement letter that i live here with my fiance. But my flight to back to my country is on 22 June.
            Is it possible for me to finish my residence permit before my flight?
            And if my residence permit already finish before 22 June, will i easily and free go inside-outside turkey without visa (because maybe i got a turkish identity card or something from residence permit)?

            If you complete all missing documents before your flight, in this case the officer of İmmigration office will provide you with the temporary residence permit, which allows you to stay outside of Turkey for 15 days. İf you dont prepare missing documents untill the flight, you should pay the administrative fine at the airport. After getting a new visa, you may come back to Turkey.

  7. My residency permit runs out today but i leave to go back to my home country in 9 days, as this is within 10 days and Im leaving will I get fined? Also I plan to come back on e visa and will likely apply for new residence permit will there be a problem?

      If you have overstayed or you wil be overstaying in turkey you will have to pay a penalty at your exit of territory.

      If you are planning to come back to Turkey you will have to pay the penalty in order to be able to re-apply for a Visa. If you don’t pay the penalty you will not be able to get a new visa at your next entry of territory. Also you might be asked to apply for a residency permit within 10 days at your next entry of territory if you have overstayed one time in Turkey.

    i visited turkey last year and i have been there for 57 days but my visa was for 30 days only as visit type , in airport i was so late and i traveled without paying fine 90 tl , i applied for new visa last feb and i got it normally , i went there but at ataturk airport they told me u have ban , u should go bk to cairo and apply again for SPECIAL not normal visa to remove ban then u can come back again , i applied quickly and i didn’t prepare my papers well , so after 1 month i got that i’m rejected ,
    so now what can i do ,
    it so deep humanity situation bcz i have long love story with my turkish girlfriend and we have to live together and start our life
    i need to know solution also how can i know duration of ban , ONLY 27 DAYS overstaying

      In order to get further information about your ban you should check with your local consulate. Since you have a temporary ban we cannot do anything you must check with the possible solution with your local consulate.

      You also check if your girlfriend can send you a letter of invitation for you. This might also be a solution for you but as told you above you should first check with your local consulate.

  9. I arrived in Turkey on March 2, 2017 and my flight departure back to the United States (I am American) is on June 15th, how much would i have to pay in fines to leave the country without a ban? Also, is there a way i can extend my visa duration to cover the additional 15 days i will be in the country?

      You cannot extend your Visa duration once you are in Turkey. In order to be able to stay longer in Turkey you must apply for a Residency Permit. Also we cannot tell anything concerning the penalty you will have to pay at your exit since they are directly calculated at the customs. However it should not be more than a couple of hundreds of Turkish Liras.

  10. Hello.
    I have a certain issue and i am looking for some help.
    I am currently in Turkey for 3 years and my visa has been expired for more then 2 years. I am planning on taking care of everything ofc now seeing i wanna stay here normally with my Turkish girlfriend
    The issue i am having currently is that my house owner started creating problems and he wants to kick me out even though i have a contract signed under my own name. The issue being there is water coming in everywhere and i don’t wanna pay rent ( or at least a normal discount ) until this issue is resolved bu the home owner. I am thinking of going to the police because they are threatening to change the locks and throw everything on the street along with my 2 cats and resolve this issue as it might otherwise get out of hand and also speak to a lawyer.
    My question then is what will happen if they find out i overstayed my visa? Will they do anything or just give me a warning like you mentioned to someone before me? Saying the police will only hand out a warning?

    Hoping you are able to answer this question soon seeing i only have 3 days left before they are planning to throw me out even though i have my rights with a contract.
