Residence Permit in Turkey

Attention: Within the scope of İmmigration Law of 6458 article no: 31-1 (e)(Touristic residence permit), foreigners who already obtained their residence permit for 1 year on tourist purpose previously, will not be able to extend their residence permit from 01.01.2020, in case if the purpose of staying will remain the same.

Turkish residence permit system is governed by the Law on Foreigners and International Protection (Law no: 6458, Enacted 11.04.2013). In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, the total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners who intend to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

DURATION OF STAY SHOULD NOT EXCEED 90 DAYS
According to above mentioned decision of the Council of Ministers, if their visa exemption period or duration of the visa is sufficient, foreign visitors may remain in Turkey without residence permit maximum for 90 days (either consecutively or separately) in any 180 days period prior to their departure. After 90 days, in order to remain in Turkey, foreign visitors need to apply for residence permit. If visa exemption period or the duration of the visa is less than 90 days, foreign visitors might extend this period up to 90 days within Turkey.

THE 180 DAY PERIOD IS CONSIDERED RETROSPECTIVELY
In calculation of 180 days limit, Law no. 5683 states that foreign visitors are not permitted to exceed 90 days within previous 180 days from their date of DEPARTURE. This means in the calculation of duration of stay in Turkey, foreign visitors should look backwards from their present point or from the day of their departure.

RESIDENCE PERMIT APPLICATIONS

Currently, residence permit applications are made directly to the newly established Directorate General of Migration Management through the online system. You may refer to Law on Foreigners and International Protection for detailed information about the residence permit application procedure, the different types of residence permits and the extension applications.

Residence Permit extension applications might be submitted online within 60 days before and in all circumstances before the expiry date of the residence permit. After the extension application, applicants will be given a document which is not subjected to administrative fees. During the extension evaluation period, foreigners will use this document to continue residing in Turkey legally.

Although it has been underlined that starting from 01.01.2015, First Residence Permit applications will be made through the Turkish Consulates, until further notice from General Directorate of Migration Management, first residence permit applications can also be made within Turkey through local offices of Directorate General of Migration Management.

From May 18, 2015, Residence permit applications started to be accepted through E-Residence system launced by Directorate General of Migration Management.

For the first applications and applications for transfer, foreign applicants need to fill the online form and get an appointment from the nearest office of Directorate General of Migration Management through the “Central Appointment System”. After filling the form, the system automatically shows the address of the nearest DGMM office and the list of the required documents, it calculates the application and card fee and also sets the available dates and times for the appointment . Foreign applicants can legally reside in Turkey with the application form until the appointment date. However having an appointment does not grant any right to enter or exit Turkey. Once the application is submitted on the appontment date and after having signed and stamped the Residence Permit Application Document, foreigners might exit and re-enter Turkey within 15 days.

In order to start the application form, system will ask for a cell phone number or email. As soon as you will receive verification code by email or SMS, you can continue your application form.

If you have already started to fill the application form,  you can continue filling it anytime by clicking on I WANT TO CONTINUE MY APPLICATION

As soon as you finish filling the application form, the next step is to arrange an appointment. For foreigners, who reside in Istanbul, the appointment date and time will be given by the system automatically. Foreigners, who reside in other provinces are able to choose the date and time of the appointment by themselves.

Once you choose the appointment date, the system will automatically calculate your residence permit fees, which could be paid by credit card or at Tax Office of your province.

Moreover, foreigners have an option to cancel the application form.

Typical short term residence permit application form contains the following parts.

Individual’s Information
Travel Document Information
Permanent Address and Contact Information
Information on place of education and work
Information on main address and contact in Turkey
Information on Residence Permit
Information on Notification

Applications for extension are also made through the e-residence system. Applicants are required to fill similar forms and send the required documents along with the application form and payment receipts to the address of the nearest DGMM office within 5 business days. After filling the application form, an application document for residence permit is produced by the system. Foreign applicant is allowed to reside in the country legally using the application document as a residence permit until the completion of residence permit procedures, but this document does not grant the right to enter or exit the country.

WHAT ARE THE REASONS FOR EXTENDING TOURISTIC RESIDENCE PERMIT?

This content is related to the residence permit extension restriction that will start in 2020 and is written to illustrate the reasons for residence permit extension, it is not legal advice, it does not have any binding features.

The Immigration Authority (Göç İdaresi) has decided to apply restrictions on extending touristic residence permits since 2020. According to unofficial figures, they say there are about 300 thousand foreigner who have a short term residence permit which is known as toruistic residence permit. What is the reason?

When the foreigners apply for a residence permit, the Immigration Authority determines a day for the appointment and the foreigners go to the Immigration Authority with their documents on the day of the appointment. Paper work viewing immigration experts are asked about their purpose of stay in Turkey to foreigners, the purpose of stay of foreigners accepted as grounds stated and added to the file. Immigration experts examine the reason stated by the foreigner and forward their decision to the foreigner via SMS.

What are the invalid reasons for extending a residence permit?

    Hello,
Is it true to purchase any value property in Turkey to obtain Turkish citizenship/passport in 5 years? Any value property means anything as long as title documents remain in buyer’s name?

Moreover, please also confirm, in above scenario, initially Government issues 2 years “Touristic residence permit ID card” purpose to stay for real estate ownership and extend the residence permit consecutive under the same purpose for 3 years and does not require mandatory or continued stay in Turkey?

If above situation is correct, then please do let me know how you can help me to obtain Turkish citizenship/passport?

I can invest 200K TL but not able to invest 250K USD as of now.

Please do let me know my options.

    Thanks,

    • Expatguide

      Hello,

After you purchase a property in any value in Turkey you will be eligible for residence permit for property owners. This kind of permit is usually granted for one year at first and later can be extended multiple times up to three years each time for as long as property ownership will be remained. If you stay in Turkey for five years uninterruptedly on basis of this kind of permit you can be eligible for Turkish citizenship application. Uninterrupted stay in this case means that you should not stay abroad for longer than one year in total within five years before submission of the application and for more than six months in a row. Moreover, in order to submit Turkish citizenship application you should have stable income and General Health Insurance in Turkey.

  • Nari

Hi. I am Nari from Kyrgyzstan.

Currently working and holding a work permit.
I am planning to quit a job and work as a commissioner at home. Hence I applied for a touristic visa for 1 year but the immigration office rejected by saying I already used my touristic visa till 2021.
Hence I have a choice of becoming a student or but house or get married.
I am not able to to either of them.
Is there any other ways to get the residency for 1 year?
I saw there is a ticari ikamet. Am I currently being in Turkey and agreeing with local Turkey company to work as a commissioner will be enougrrqson to get ticari ikamet? If yes, what are the requirements?
Also are you able to offer me any options and if yes what is the cost?
    Thanks,

    • Expatguide

      Hello,
In order to work in Turkey and have an income generated within the country you must be a work permit holder. Foreigners can not do job activity on basis of residence permit. Ticari ikamet can be granted on basis of entering Turkey on business visa if you can prove by related documents that your job activity abroad requires presence in Turkey due to cooperation with Turkish company/companies.

Great website! With a US Passport, I arrive for my 90 days. If I work online and receive over 1,000 USD per month, can I get a residency card for 1yr? If not, do agents in Istanbul make this happen?

    • Expatguide

      Hello,
As the US citizen you can obtain touristic residence permit after entering Turkey and before expiration of your visa. In order to make an application, foreigners must have address in Turkey and health insurance obtained within the country, which is covering the whole requested period of stay. Minimum official monthly amount of income, which foreigners should prove to apply for residence permit is 500 USD. With monthly income of over 1000 USD you are eligible for residence permit if you meet all other criteria.

    Hello,
I live here ans work here more than one year I have my work permit is valid but due to the pandemic my company put us on free leave without any salary. I found a job but in this job they need a residence permit to apply for my new work permit. My worry is that goç idaresi will not accept my application because I am not from OECD countries. Can the new employer apply unstead? Thank you.

    • Expatguide

      Hello,
If your work permit has not been cancelled by previous employer, it can be transferred to a new workplace. Work permit transfer can be made only if both employers agree to do the procedure. Otherwise after your work permit is cancelled new work permit application can be made via Turkish consulate in your home country. Once the application is approved you can reenter Turkey on basis of work visa with no need to apply for residence permit. Our company provides services regarding work permit application and transfer and we can assist your employer throughout the process. For details you can contact us at info@expatguideturkey.com

Hey, I have seen that you say that residence permits can be extended on the basis of buying property in Turkey. Does the property have to have a certain value? And can it be bought with a Turkish citizen, or must it be only on my name?

Also, what are the rules on extending permits for UK citizens? Are they different to the rules for EU citizens?

And are there any variations to the rules on applying for residence permits during coronavirus?

    Thanks a lot!

    • Expatguide

      Hello,

There is no minimum value of the property to be eligible for residence permit application, however for this purpose you should be the only owner of the property. UK citizens can extend their residence permit in Turkey. Currently the only difference in application procedures are appointment dates in Istanbul. Foreigners must send the documents by post instead of attending the appointment. This change does not apply to other cities.

    Hello,
Can citizens of Kyrgyzstan obtain a tourist residence permit for one year, and reapply again after one year? As health insurance is mandatory, are there any options to buy a comprehensive and good one? What are the options for coverage?
    Thanks

    • Expatguide

      Hello,
Citizens of Kyrgyzstan currently can obtain touristic residence permit for maximum one year only once within two years. There are various health insurance policies available for foreigners in Turkey and the coverage depends on type of policy. You can choose any of them to benefit from health care within Turkey and for residence permit application purposes under condition that the policy includes inscription that it is compatible with requirements of Directorate of Migration regarding residence permit application.

Hi, my wife and I are both EU citizens (Austria and Netherlands), and intend to move to Istanbul in a few months. We will initially apply for a tourist residence permit for one year. Can you tell me how often you can normally extend such a permit with another year afterwards? We will not have local employment.

    • Expatguide

      Hello,
Currently touristic residence permit can be granted for up to one year and EU citizens are allowed to extend their permits every year. There is no limit regarding amount of extensions. Each extension application can be submitted the earliest two months before expiration of residence permit. Foreigners must be present in Immigration Office for appointment date during each application.

Hello I hope you are doing well. I come from Afghanistan and have been living in Turkey for 4 years with my family wife and 2 children. I applied for the renewal of our residence permits. Mine my children’s applications have been approved but they cancelled my wife. It’s too difficult to get a visa in Afghanistan to reenter Turkey. Is there any other way to renew her residence permit. My children go school here and they are under 18 years old.

    • Expatguide

      Hello,
Unfortunately, it is not possible to reapply for residence permit without leaving and reentering Turkey with new visa. Please, be informed that your wife can not apply for the same type of residence permit during 6 months upon submission of the application, which has been rejected. If your wife finds a job in Turkey future employer can apply for work permit right after your wife leaves the country and once the application would be approved, your wife will reenter Turkey with work visa and can stay within the country on basis of work permit with no need to obtain residence permit separately.

Hello I am Jamaican and have been living in Turkey for almost 2 years. My residency expires in September 2020. Because of the new rules it seems that i won’t be able to reapply for another extention. Can i leave and return on a visa and then apply once more? Is there another option?

    Thanks much

      Hello,
Touristic residence permit currently can be obtained only once within two years, which means that until there is no other purpose of stay than tourism, you can renew your residence permit the earliest in September 2021. If you purchase a property in Turkey, you can be eligible for residence permit on this basis or if you find a job, your future employer can apply for work permit before expiration of your current residence permit.
