NEW STANDARDS FOR THE CONSTRUCTION PROJECTS

New amendments in the “Regulation on the planned areas type zoning” have been published in the Official Gazette on 8th September 2013 (Official Gazette No. 28759).  Regulation on the planned areas type zoning establishes rules and principles regarding to the required standards in the constructing projects. With the effect of new amendments, some major changes in the regulation are as follows;

CONSTRUCTION OF (1+0) STUDIO FLATS ARE NOT ALLOWED  

By the virtue of new amendments, article 38 of the Regulation on the planned areas type zoning has been changed as follows;

Each detached house has to have minimum;

  Narrow Side Area
1 Living Room 3.00m. 12.00m2
1 Bed Room or Niche 2.40m. 8.00m2
1 Kitchen or Niche 1.50m. 3.30m2
1 Bathroom 1.20m. 3.00m2
1 Toilet 1.00m. 1.20m2

Bathroom and Toilet might be in the same place in the houses with three or lesser rooms.

Width of Hall and Corridors cannot be lesser than 1.10 meters.

REDUCTION IN THE NUMBER OF FLOORS (STORIES) ALLOWED IN BUILDINGS

With the new amendments, number of floors that buildings are allowed to possess is reorganized according to the width of the street on which they are constructed. Accordingly on the streets;

Up to 7,00 m.  :  No more than 2 floors (excluding basement)

7,00 m. and more  : No more than 3 floors (excluding basement)

10,00 m. and more  : No more than 4 floors (excluding basement)

12,00 m. and more  : No more than 5 floors (excluding basement)

15,00 m. and more  : No more than 6 floors (excluding basement)

18,00 m. and more  : No more than 7 floors (excluding basement)

20,00 m. and more  : No more than 8 floors (excluding basement)

25,00 m. and more  : No more than 10 floors (excluding basement)

30,00 m. and more  : No more than 12 floors (excluding basement)

35,00 m. and more  : No more than 14 floors (excluding basement)

40,00 m. and more  : No more than 16 floors (excluding basement)

50,00 m. and more  : No more than 18 floors (excluding basement)

CHANGES IN DEFINITION OF CENTRAL BUSINESS DISTRICTS

Different from the previous definition of CBD, with the new amendment, CBDs cannot be far away from the city centers. Casinos are excluded from the definition of CBD. Religious temples, financial centers, sport centers, open space areas such as parks and grounds and touristic-purpose constructions are added into the definition of CBD.

CELL TOWERS (BASE STATIONS) CAN BE CONSTRUCTED ONLY BY THE CONSENT OF OWNERS.

Within the private property (land or buildings) cell towers can be constructed by the affirmative consent of all owners. In the public areas, cell towers can be constructed with the approval of Information Technologies and Communication Authority.

CHANGES IN THE STATUS OF THE HIGH QUALITY HOUSES (RESIDENCES)

High Quality Houses (residences) were included within the Commercial Areas category. With the new amendments, residences are placed within category of House. Especially for the tax purposes, from now on, High Quality Residences will be accepted as house not commercial areas. In order construct multi-floored auto parks, private education o health facilities, previously, residences were not required to apply for change in the zoning ordinance.  With the new amendments, for these types of constructions, change in the zoning ordinances will be required.

RESIDENTAL BUILDINGS WITH 30 HOUSES REQUIRED TO HAVE PORTER’S DWELLING

Those residential buildings, using solid fuel and which have 30 and more houses are required to have one porter’s dwelling. Those residential buildings using fuel or natural gas, in the case of having 50 or more independent units (individual divisions in the building) are required to have porter’s dwelling.
