Address registration system

Especially with the introduction of new Law on Foreigners and International Protection, importance of the Address Registration System (AKS) for the foreigners living in Turkey has increased. Although registry of address information to the AKS by Turkish nationals and foreigners resident in Turkey has been compulsory since the establishment of the system, new Law on Foreigners and International Protection clearly stipulates the obligation to be registered in the Address Registration System. In general article 26 (2) Law on Foreigners and International Protection states that;

“Foreigners who arrive in Turkey with residence and work permits obtained from consulates shall register in the address registration system within twenty working days as of the date of entry.”

Moreover for family residence permits, registration in the AKS is a required condition.[1] Additionally in several sections of new law, specific mentions to the obligation of registration in AKS are made. Especially for the holders of humanitarian resident permit holders[2] and those foreigners within the scope of international protection[3], obligation of registration in AKS is underlined.

WHAT IS ADDRESS REGISTRATION SYSTEM

In accordance with section eight (8) of Law no.5490 on Civil Registration[4] the “Address Registration System” has been established to keep address information of Turkish nationals and foreigners resident in Turkey electronically. The AKS system is integrated with the MERNIS system which is storing personal data such as “Name, Surname, Mother’s and Father’s Name, Place of Birth and Information on Civil Status Events” based on Turkish Republic Identity Number (Turkish National Identity Number).  In pursuance of Turkish Civil Code, “change of a residence address is subject to the acquirement of another one”[5], thus

Turkish nationals and foreigner residents are required to make address change notification within 20 working days.

Address registration might be made by the declaration of person.  Such declaration should be made in writing to the District civil registration offices, Turkish Representations abroad or Agencies providing address-based services such as muhtar offices.

In case of failing to fulfill obligation of notification, 250 Turkish Liras administrative penalty shall be applicable. False notification shall be subject to 500 Turkish Liras administrative penalty and additionally might result in imprisonment of 6 months to 4 years.

AMENDMENTS IN THE LAW ON CIVIL REGISTRATION  

Article 123 (7) of Law on Foreigners and International Protection provides important changes on the articles related to the civil registry of foreigners resident in Turkey. Before the entry into force of Law on Foreigners and International Protection, foreigners who are holding residence permit valid for minimum six (6) months were provided with Turkish National Identity Numbers and recorded into foreigners’ log. (Before the entry into force of new law, holders of residence permit valid for minimum six (6) months were required to be registered with Address Registration system.[6])  By the entry into force of new law, this minimum duration is reduced from six months to ninety days.  This change is provided by the virtue of following changes in the articles 3(1) and (8(1) of Law on Civil registration;

a) Article 3(1) (çç) is amended as follows:

“(çç) Foreigners Log: is the log containing the records of persons granted a Stateless Person Identity Card in Turkey or foreigners who are granted a residence permit for any reason for the duration of minimum ninety days and foreigners legally staying in Turkey who apply for a foreigner’s identity number,”

b) Article 8(1) is amended as follows:

“Foreigners who are granted a residence permit for any reason for the duration of minimum ninety days in Turkey shall be entered into the foreigners log by the Directorate General. However, foreigners legally staying in Turkey shall also be recorded in the foreigners log upon their demand. Foreigners entered into this log are liable for reporting all registry related incidents to registry offices. This provision shall not apply to members of diplomatic missions.”

  • Hi, I am a foreign student who lived in a dorm and now in a shared apartment. I am trying to renew my residence permit and will submit through the school.

    How can I provide my address?

    Can I face any problem if during my renewal my actual residence expire? My residence is due to expire on the 1/10/2020 and I haven’t yet submitted my application for renewal

      Hello,
      Your address must be proved by notarized rental contract with your name mentioned in it. You can stay in Turkey legally until receiving new residence permit card even if your current residence permit expires during the application process, however you should not leave Turkey before receiving new card.

    I signed a one year contract to rent an apartment, but now after two months I will end the contract and pay the penalty fee to the landowner. I also decided to go back to my home country (Iraq) for 60 days and then return back to Turkey after that. So, what should I do regarding my address? I will have no valid address within the 60 days which I will spend in my country. For your information, I have 8 months left for my touristic permit to expire.

      Hello,
      Once you reenter Turkey and find another apartment you must change your address in local Directorate of Population or through e-devlet system. Foreigners must register they address change within 20 days upon moving to another address.

    So glad I found this article! Our issue is the last two residents of the apartment are still listed with the registry and we are unable to use the address as our own. We just signed the lease. Have you seen this issue before?

      Owner of the appartment should inform Civil Registry Office about current tennants so you would be able to get registered under address of your residency.

    I currently rent a room (in a shared apartment) from a Turkish citizen but it’s short term and we don’t have a contract. To register this as my address would I need the landlord to come to the Nufus with me, or would a written and signed note from him be enough? I need to register an address as I will be renewing my residence permit soon.

      If your landlord is also registered at the same address, they would need to visit Civil Registry Office with you to confirm that you are living at provided address.

    Hello , I tried to register my address with the contract I got form the landlord, went to Nufus and they said they couldn’t find the apartment number on the system, what shall i do now ?

      You should check up with your landlord for any official documents of the appartment as the address there may slightly differ from the one stated in the contract.

    After trying to change my address and trying to find my ID number on the system . it says i am not in Turkey .I sighed up at the ptt with my id card , i have a password for the system , i have been and registered at my mutharlic , i have lived here with an id and yabanci number for over 6 years now , why does the system say i am not here ?

      You should visit Civil Registration Office (Nüfus Müdürlüğü) as probably an error regarding your address registration occured and it can be fixed in there.

    Hello, i need an answer about which is the article that write about rights of a UE citizen and turkish rezident in same time. In my case the police canceled my residence permit because they said me, they couldnt find me in house, but in that time i am traveling so is obvoius cant find me at house. So they canceled to my residence permit without any warning and after that they didnt send me any notification because they made that. I discovered that accidentally when i needed to change my adress. I had like to find the law about my rights for prouve the abuse of turkish police. Good evening!

    Or, Can I apply for a one year visa when I arrive in Turkey after opening a business?

    I am so confused right now. I never heard about this, nor is this information that has ever come to light in the local area where I live, or the foreigner association in our area. I thought one only had to register with the muhtar, and if you change address inform the authorities that supplied the residency visa.
    so…since i’ve been here quite some years, where should i go and am i now liable for a fine?

It is sure that AKS system will be more effectively used by foreigners after April 2014. However regulation for the address registry is effective since 2006.
