FUTURE AMENDMENTS IN THE LAW ON WORK PERMITS OF FOREIGNERS

It has been more than three months that Law on Foreigners and International Protection has been accepted and officially published in the Turkish official gazette.[1] As it is clarified by the article 125 of new law, except certain provisions regarding to the establishment of General Directorate of Migration Management, all other provisions shall enter into force one year after the publication date. However, new law also indicating some major changes in the other legislations such as Turkish Citizenship law and Law on Work Permits of Foreigners.

ACQUISITION OF TURKISH CITIZENSHIP – PART I –

Law no. 5901 on Turkish Citizenship defines the principles and the procedures regarding the conduct of affairs and processes relating to the acquisition and loss of Turkish citizenship. Turkish citizenship may be acquired by birth or after birth. Turkish citizenship automatically acquired by birth on the basis of descent or place of birth. On the other hand Turkish Citizenship Act specifies three main ways to acquire Turkish citizenship after birth. Accordingly, Turkish citizenship may be acquired after birth (i) by decision of the competent authority, (ii) by adoption or (iii) by choice.

GROUNDS FOR REJECTION OF WORK PERMIT APPLICATIONS

Article 14 of the Law on Work Permit of Foreigners defines the grounds for rejection of work permit applications. As a general rule, foreigners may not be granted with work permit, if needed work force can be obtained domestically from local labor market.
